By default the privacy policy checkbox is always added to the bottom of a form. However you can choose to move it before of a certain element, for example before the submit button of the form.

To do this you can use the parameters visible in the image below, activating the 'Custom append method' and using a CSS selector to match the desired element of the form. Using standard values the checkbox will be appended before the submit button.
